Article 1 – Scope of Application

The general terms and conditions of sale set out below (hereinafter referred to as the “General Terms and Conditions”) govern the contractual relationship between any user of MYSALONDECOIFFURE (hereinafter referred to as the “User” or “You”).

These general terms and conditions of sale are the only ones applicable and supersede all other terms and conditions, unless expressly agreed otherwise in writing in advance.

SARL YR may from time to time amend certain provisions of these General Terms and Conditions; it is therefore necessary to review them before each visit to the SARL YR website (hereinafter referred to as the “Website”).

We consider that by confirming your order, you accept our general terms and conditions of sale without reservation, having read them. By accessing the Website, you agree to comply with the General Terms and Conditions as well as the Terms of Use set out therein.

Article 2 – Contract / Conditions for placing an order

You declare that you are at least 18 years of age and have the legal capacity, or hold parental authorisation, to place an order on the Website.

Article 3 – Contract / Steps to conclude the contract

Once you have placed your order, we will send you an email confirming the details of your order. This email constitutes our acceptance of your order and thus forms the contract of sale between us and you.

Article 4 – Order Confirmation

For security reasons, all orders paid for by credit card are subject to verification by SARL YR. You will be asked to provide certain information to confirm your purchase. Consequently, and to avoid any delays, please ensure you enter the following when placing your order: • a valid personal or business email address. • A precise delivery address (workplace or home).

Article 5 – Prices

The prices shown on the Website are in euros, excluding VAT and delivery charges. Any delivery charges are payable by the User and are invoiced at the end of the ordering process in addition to the selected products.

We reserve the right to change our prices at any time, but we undertake to apply the current prices shown on the Website at the time of your order.

Article 6 – Availability

Please note that we will fulfil your order subject to stock availability. In the event that any of the products ordered are not in stock, we undertake to contact you by email or telephone within 30 days of the date of your order to inform you of this and to let you know, where applicable, when that product might be delivered to you.

Article 7 – Product information

In accordance with Article L111-1 of the Consumer Code, the user may, prior to placing an order, view the essential characteristics of the product(s) they wish to order on the website by clicking on the product.

The photographs illustrating the products and the graphics are for illustrative purposes only; they do not form part of the contract and shall not give rise to any commitment on the part of SARL YR.

Article 8 – Payment

Payment for your order can be made by credit card (CB, Visa or Mastercard).

For credit card payments, the transaction will be processed securely via Cyber Plus, the Bank’s secure online payment service. All data entered by the user when paying by credit card is immediately encrypted using the SSL protocol and stored on the Banque Populaire server. Information is entered directly via a connection to the bank’s payment server. For security reasons, no payment details relating to the user are stored on the website www.mysalondecoiffure.com. The amount will be debited on the day of your order, provided that authorisation to debit your account has been obtained in advance from the relevant payment centres; otherwise, your order cannot be processed.

In the event of a refund, the User will be refunded via a credit to their bank account if payment was made by credit card.

Article 9 – Guarantees and After-Sales Service (“SAV”)

Certain items are covered by a warranty, the terms of which are provided with the product. Whatever the issue with your item, you must include a copy of the invoice and the warranty certificate with the faulty item. The warranty does not apply to the repair of damage resulting from use that does not conform to the product’s normal intended use. The warranty does not cover transport costs.

Article 10 – Agreement on Evidence

The Customer acknowledges the admissibility as evidence of computer records, computer reports and printouts, and other electronic media, particularly in the context of any dispute arising from a breach of these terms by either Party.

Article 11 – Delivery

In certain cases, MYSALONDECOIFFURE may make a partial delivery. The remaining items will either be delivered at a later date, replaced with alternative items of your choice, or refunded.

The products ordered are always transported at the User’s own risk; the User must check that the goods are in good condition upon arrival of the parcel and has 24 hours to raise any objections with the carrier in the event of missing items or damage. The customer must then immediately notify MYSALONDECOIFFURE by sending an email to the following address: mobicoiff@gmail.com

Any complaints must be sent to the email address given above.

The delivery times stated on the Website are for guidance only and may be subject to change.

If a parcel is not received within the specified time frame, an enquiry will be made with the carrier, which may take several days (e.g. 21 days with La Poste). During this period, no refunds or returns can be processed.

Upon receipt of your order, you must check that the products delivered match your order and, where applicable, note any discrepancies on the delivery note in the form of handwritten reservations accompanied by your signature. You must also confirm these reservations in writing to MYSALONDECOIFFURE, either by post or email (mobicoiff@gmail.com), on the same day or at the latest one working day after receiving your order.

Any claim made outside this timeframe cannot be accepted and will release MYSALONDECOIFFURE from any liability towards the User.

If the products need to be returned to us, they must be sent back within two working days of delivery to the address of SARL YR.

Returns will only be accepted for products in their original condition, namely including their packaging, accessories and user manuals. Postage costs are to be borne by the User. mobiliercoiffurepro cannot be held liable in the event of a delay in postal delivery.

Article 12 – Liability

SARL YR shall not be held liable for any failure to perform the contract in the event of force majeure, disruption or total or partial strike action, in particular affecting postal services, transport or communications, flooding, fire or war.

SARL YR shall not be liable for any indirect damages, operating losses, loss of profit, loss of opportunity, damage or costs that may arise as a result of the purchase of any product featured on the Website.

We would remind you that it is prudent to back up the data contained in the products purchased. SARL YR shall not be held liable for any loss of data or files, or more generally for any damage resulting from the User’s failure to back up the data contained in the products purchased.

SARL YR shall not be held liable for any consequences resulting from the misuse of products sold on the Website.

The total inability to use the products, in particular due to hardware incompatibility, shall not give rise to any compensation, refund or liability on the part of SARL YR.

Hyperlinks may lead to websites other than this Website. SARL YR accepts no liability in the event that the content of such websites contravenes the legal and regulatory provisions in force.

SARL YR’s liability shall, in any event, be limited to the amount of the order.

Article 13 – Right of withdrawal – Satisfaction or your money back

In accordance with the provisions of Article L 121-20 of the Consumer Code, you have 14 working days to return a product to us if you are not satisfied with it.

You may return the product within this period, at your own expense, accompanied by your invoice. Only products in new and complete condition (including accessories, instructions, etc.), returned in their original packaging and sent to: SARL YR, 12 RUE JACQUARD, 69680 CHASSIEU, will be accepted.

Any product that has been damaged, or whose original packaging has been damaged, will not be refunded or exchanged. If the item is returned to SARL YR incomplete or damaged, a discount will be applied to its price based on the assessment carried out by our after-sales service.

The time limits mentioned above run from the date of delivery of the order. This right of withdrawal may be exercised without penalty, except for the cost of returning the goods.

Should the User exercise their right of withdrawal, they may choose either to request a refund of the sums paid or to exchange the product.

In the case of an exchange, the products to be received in exchange will be dispatched to the User at their own expense.

If the right of withdrawal is exercised, SARL YR will do its utmost to refund the User as quickly as possible.

The User will then be refunded via a credit to their bank account if payment was made by credit card, or via PayPal in all other cases.
